Welcome! These general terms and conditions apply to all services and products provided by Sina Blum. Please read them carefully.

1) Anwendungsbereich

1.1
These General Terms and Conditions apply to all services provided by SINA BLUM. FOTOGRAFIE | MEDIEN-DESIGN | KREATIV-STUDIO, both to private customers and businesses (according to §§ 13 & 14 BGB — German Civil Code).
1.2
By placing an order — whether via email, phone, or online — you accept these Terms and Conditions as part of our contractual relationship.
1.3
These Terms also apply to all future orders, even if not explicitly referenced again.
1.4
Any deviations must be agreed in writing. Terms proposed by customers are only valid if acknowledged in writing by us.
1.5
Prices valid at the time of booking apply. Special offers are limited in time or availability as stated.

2) Contract Formation & Subject Matter

2.1
Contracts cover services or products you order, including photography (digital and print), photo reports, photo shoots, media design (flyers, digital media, layouts), and other creative services (collectively “Media Products”).
2.2
The contract is based on the offer provided by SINA BLUM | FOTOGRAFIE. MEDIEN-DESIGN. KREATIV-STUDIO. Unless otherwise stated, offers remain valid for four weeks from the time the offer was received.
2.3
By accepting an offer (including by email or phone), you agree to the conditions and these Terms.

3) Copyright

3.1
Copyright for all photos and other media products remains with Sina Blum.
3.2
Upon contract fulfillment, we grant a licence for usage (rights of use) for the delivered media; ownership & copyright stays with us.

4) Right of Use

4.1
Clients generally receive a simple, non-exclusive private right of use only.
4.2
A editorial right of use (e.g., journalistic or educational use) requires written agreement and may be fee‑based.
Non-compliance results in a fine.
4.3
A ecommercial right of use ) requires written agreement and may be fee‑based.

4.4
Clients must credit the photographer when published online or in print.

4.5
Any further editing by clients or third parties is prohibited unless agreed in writing. Non-compliance results in a fine.
4.6
All rights of use transfer only after full payment.

5) Fees, Ownership, and Payment

5.1
Costs depend on the service or package booked and are listed in your quote and invoice. The invoice is to be paid to: SINA BLUM | FOTOGRAFIE. MEDIEN-DESIGN. KREATIV-STUDIO.
The payment deadline as indicated on the invoice must be met. If the payment is not made by the deadline, SINA BLUM | FOTOGRAFIE. MEDIEN-DESIGN. KREATIV-STUDIO is authorised to collect a late fine according to § 288 BGB (German civil code)
5.2
Rights of use transfer only after full payment is received.
5.3
For booked shoot dates, a 20% deposit is required. If not received in time, the booking may be cancelled.
5.4
Additional costs (travel, fees, model fees, etc.) are payable by the client if not included in the package.

6) Cancellation by SINA BLUM | FOTOGRAFIE. MEDIEN-DESIGN. KREATIV-STUDIO

6.1
If SINA BLUM | FOTOGRAFIE. MEDIEN-DESIGN. KREATIV-STUDIO cannot perform due to illness or force majeure, no claims for damages can be made by clients.
6.2
We will attempt to find a replacement photographer; any resulting extra costs are the client’s responsibility. This is a voluntary service by SINA BLUM | FOTOGRAFIE. MEDIEN-DESIGN. KREATIV-STUDIO. Clients have no binding claim.
6.3
Minor changes or reasonable location changes do not entitle a refund or cancellation. If a photo shoot must be cancelled for reasons not listen in 6.1, SINA BLUM | FOTOGRAFIE. MEDIEN-DESIGN. KREATIV-STUDIO will pay back payments that may have been made alreay. The client has no further claims.

7) Cancellation by the Client

7.1
Once a booking is confirmed in writing, the date is reserved exclusively for you.
7.2
A deposit of 20% of the order value is due upon a date specified in the contract.
7.3
Cancellation fees depend on how far in advance you cancel:
‑ More than 6 months before: 20%
‑ 3–6 months: 35%
‑ 1–3 months: 50%
‑ Less than 1 month: 90%
7.4
For non-date based service (e.g. design projects) the following is applicable:
A 20 % deposit must be made at the time of booking.
The deposit is non-refundable in case of the client making a cancellation.
If the contract value equals EUR 500,00 or more, SINA BLUM | FOTOGRAFIE. MEDIEN-DESIGN. KREATIV-STUDIO may require clients to make partial payments as the project progresses. This will be documented in a written agreement.

8) Event Photography

8.1
For photography or filming during events, SINA BLUM | PHOTOGRAPHY. MEDIA DESIGN | CREATIVE STUDIO points out that it is the client’s responsibility to ensure that all participating guests are informed that photos and/or videos will be taken during the event (in accordance with Art. 6(1) sentence 1(a) GDPR). Obtaining consent from the guests is the client’s responsibility.

If any individuals do not consent to being photographed or filmed, it is the client’s responsibility to communicate this to SINA BLUM | PHOTOGRAPHY. MEDIA DESIGN | CREATIVE STUDIO. SINA BLUM | PHOTOGRAPHY. MEDIA DESIGN | CREATIVE STUDIO assumes no liability. The client agrees to hold SINA BLUM | PHOTOGRAPHY. MEDIA DESIGN | CREATIVE STUDIO harmless from any claims by third parties regarding violations of personal rights or similar issues.

8.2
Clients are obliged to check in advance whether photography or filming is permitted in the chosen venue (hotel, restaurant, church, etc.) and to obtain the property owner’s consent. If the client fails to obtain such permission and the property owner or another authorized third party prohibits SINA BLUM | PHOTOGRAPHY. MEDIA DESIGN | CREATIVE STUDIO from taking photos, the client bears responsibility.

9) Compensation and Contractual Penalty

9.1
When using the photographs in online or print media (for private use), the photographer must be credited as the author of the photos. Any violation of this right to be named entitles the photographer to claim damages.
9.2
Subject to further claims for damages, the client agrees to pay a contractual penalty for each instance of unauthorized use of the photographs without the photographer’s written consent. This includes sharing the photos with third parties, unauthorized alteration or editing, publication, or any use of the images by the client or others.

10) Data Protection / Privacy Policy

Any data provided to SINA BLUM | PHOTOGRAPHY. MEDIA DESIGN | CREATIVE STUDIO by clients will be stored electronically, as far as necessary for the proper handling of the business relationship. SINA BLUM | PHOTOGRAPHY. MEDIA DESIGN | CREATIVE STUDIO is committed to keeping all information obtained in the course of the assignment strictly confidential.
